Man involved in 1999 drunk driving death busted in H.B.

A Torrance man who killed a woman while driving drunk in 1999 is in Hermosa Beach jail after being arrested Friday night for once again getting behind the wheel while intoxicated. Because of his prior conviction, this latest incident could land him in jail for an extended period.

According to Hermosa Beach Police Sgt. Steve Endom, Michael Foley, 38, was arrested and charged with a D.U.I. following a routine traffic stop at 11:30 p.m. near the corner of 190th Street and Pacific Coast Highway.

According to police reports, Sgt. Tom Thompson had noticed Foley impeding traffic and attempted to pull him over at 10th Street and Hermosa Avenue. Foley reportedly ignored the police and continued to drive at 10 to 15 mph out of the city.

Foley was charged and convicted of vehicular manslaughter after driving drunk and killing Torrance resident Cheryl Ann Betar in the city of Torrance in October of 1999.

Foley remains in jail with $100,000 bail after violating his probation on the 1999 conviction. Foley was charged Tuesday with felony drunk driving with an alcohol level of .08 or higher. If convicted, Foley could face a minimum of 16 months in a state prison.

“His conviction at the Torrance Courthouse was a result of a fatal accident involving the passenger on his motorcycle,” said Endom. “State laws say that if you are convicted of a crime involving felony drunk driving and you are caught doing it again in a 10-year period, you are then charged with felony drunk driving and will spend some time in a state prison.”

According to Betar’s best friend, Susan Cordone, Foley offered Betar a ride home on his motorcycle. Foley, who was speeding, attempted to pass a car on the right and spun out of control. Betar died at the scene.

“Cheryl was on her way to see me that night and she called me right before she left,” said Cordone. “She had two kids and hopefully this man will be kept off the South Bay streets for a while.”

Foley’s arraignment has been scheduled for Sept. 16 at the Torrance Superior Courthouse.
